Immigration Package

Immigration package for citizens from so-called “third countries”*

This package informs future employees about all visa related matters. This eases the start in Germany, Poland and the Netherlands for both employers and employees and provides  traceable, transparent and competent insights into the process.

Bureaucratic hurdles on the way to a complex transfer are efficiently and reliably diminished. Thanks to trustworthy information provided by ExpatRelocation  employees as well as employers can focus on their start together.

Our service is basically for working people and their families as having a job which will enable you to finance your life is key for any immigration to Germany.

We will usually start with a telco and that will already enable to give you a hindsight, whether or not the work permit is going to be possible or an evaluation needs to take place first. Please be aware that this may not result in a positive answer, however, in most cases a visa category will be applicable.

An evaluation is undertaken by our attorneys . They will usually charge no more than an hour and will advise if otherwise. On top of the lawyers’ fees a lumpsum to cover communication expenses is charged. The evaluation fee is going to be waived in case we continue to support the applicant. If you decide to abort the services the fee is payable.

For a defined set of countries, citizens need to apply from within their home country, other citizens can apply in Germany. With the new law in force from March 2020 we will establish the state-individual approaches and guide you. Where the “fast track” does not apply, we will clarify the detailed requirements of the embassy/foreigners’ office involved.

 

Our Immigration Packages include to following options

Where necessary or beneficial our lawyers will apply for a pre-approval by the Federal Office of Employment in Germany. Under the new law this will mostly be handled by the local foreigners’ office.

When applying outside Germany, it depends on the validity period of the title the embassy granted by when the applicant needs to prolongate his residence title. When applying in Germany, the applicant has to show up at the local foreigners’ office twice. The appointment at the local foreigners’ office should be accompanied because the staff usually is allowed to speak German only and the process can be a little complex. The appointment for the visa pick-up does not necessarily need to be accompanied.

PRE-ASSESSMENT

    Our Parental Allowance Service

    Parents in Germany, Poland and the Netherlands can take a leave from work while being guaranteed their workplace for up to three years. This period can be shared between both parents, and you can even take it at the same time. Within this period you cannot be laid off from yPrice list: all services. Further, the law says that you have a right to work part-time. However, this is with a big question mark, as the company has to grant if it is possible to share your work with a colleague. And there are lots of ways to argue about this. Unfortunately, still, many companies are not prepared to be more flexible about working hours.

    In addition to this extended layoff protection, some financial support is granted to encourage future parents to actually raise children without suffering too much on the financial side. There is no income cap on Parental Leave Allowance. Therefore every mother and every father can enjoy its benefits. Generally, 67 percent of the net income is granted as Parental Leave Allowance and minimum 300 EUR per month.Non-working parents receive the minimum amount in addition to the family income. Parental allowance is paid to the father and mother for a maximum of 14 months. They are eligible to split the period between them. Neither parent may claim for more than 12 months. A further 2 months may be paid if income is lost during this period and the partner is involved in caring for the child. Single parents drawing parental allowance to compensate for loss of income are eligible for the full 14 months parental allowance.The Basic parental allowance is 65% to 100% depending on the net income before the birth.

    Eligibility:

    Mothers and fathers are eligible for parental allowance if:

    • they care for and educate their children themselves after birth
    • they are not employed for more than 30 hours per week
    • they live together with their children in one abode
    • they are resident or have their habitual place of residence in Germany, Poland and the Netherlands
    • Under certain circumstances, parental allowance may also be paid in respect of employment abroad.

    Application Procedure

    Some of the documents are only available once the baby is born and the hospitals will provide you with everything. Some documents, like your last months' income or information about siblings, can be prepared upfront. If you had no income in the last months, the application procedure is manageable, but with income to be considered it is a complex procedure.

    Application of child support or a daycare-voucher :Documents required

    Although it may slightly vary, you need to be prepared to hand in the following documentation
    • A copy of your child's birth certificate
    • A copy of your residence certificate (which will indicate your child's place of residence)

    In some states, a certain number of hours is granted without reference to your income or work situation or the age of the child. If you need more hours, or you are otherwise requested to prove your financial situation, the following documents are regularly required to calculate your individual voucher amount:

    Employees:

    • Copies of one or more payroll reports, indicating the monthly family income after taxes (not older than 7 months). In case of volatile income, an average will be calculated on the basis of all payroll reports handed in. Usually, 3 payrolls shall be sufficient
    • A copy of your Employment contract, alternatively
    • Confirmation from your future employer on start and duration of your future employment
    • A copy of the certificate of matriculation at a university
    • Evidence that you are taking part in a Hartz IV plan
    • A confirmation that you are conducting a language or integration course for migrants
    • Alternatively, and if applicable, a copy of the advice on unemployment support II (Arbeitslosengeld II)
    • Copy of the advice on social insurances
    • Copy of alimony payments

    Entrepreneurs:

    • A copy of the last annual tax assessment notice, or, if not available or not representative, an estimation of future income
    • A copy of the advice on monthly tax advance payments
    • Copies of the payments for health, accident, and life insurances

    Students

    • A copy of the advice on received BAföG payments
    • Copies of the payments for health and nursing care insurance

    If you wish to use the service of a daycare nurse, you have to provide her / his name, address, birth date and bank details as well as a confirmation of the possible acceptance of your child.

    Child allowance is granted to every family with children and shall help to bear the financial burden of children’s education. It is paid without reference to the family income. To apply for it, you and your child must be registered in Germany, Poland and the Netherlands.

    Parents are eligible to apply for “Kindergeld” (child allowance) for children up to at least the age of 18. Under certain circumstance foreign parents are also entitled to child allowance.

    Child allowance is usually paid when the applicant is domiciled or normally resident in Germany, Poland and the Netherlands. Applicants resident abroad may be eligible for child allowance if they are subject to unlimited tax liability in Germany - i.e. the bulk of their income is exclusively earned in Germany. Applications must be made in writing to the local “Familienkasse” (family office).

    As well as child benefit, certain parents are entitled to claim a supplementary child allowance (currently up to 205 euros per month) for each unmarried child who is under the age of 25 and lives in their household. In order to qualify, you need to fulfil certain conditions:

    • You receive child benefit for the child.
    • You earn at least 900 euros per month before deductions (600 euros for single parents).
    • You earn less than the maximum income limit (varies according to the parents’ cost of living and is calculated individually by the Family Benefits Office).

    The exact amount you will receive is determined by your income and assets. You can also claim extra assistance for things such as school trips, school supplies and meals. If your child has any income (e.g. maintenance payments), this will be deducted from the supplementary child allowance. You can apply for the supplementary child allowance from the Family Benefits Office at the same time you apply for your child benefit.

    EU / EEA citizens: If you are a citizen of a Member State of the EU, the EEA States, or Switzerland you may receive child allowance irrespective of whether you have a settlement permit or a residence permit. The same applies if you are a national of Serbia and Montenegro, Bosnia- Herzegovina, Morocco, Tunisia or Turkey on the basis of the respective bilateral agreements, provided that you are liable to pay contributions for unemployment benefit under the terms of your employment in Germany, Poland and the Netherlands.

    Non-EU citizens: Foreigners living permanently in Germany, Poland and the Netherlands are eligible to receive child allowance if they have a valid settlement permit or residence permit for specific purposes. One of these purposes is to pursue research according to §20.

    • For the first and second child: 188 EUR per month
    • For the third child: 194 EUR per month
    • For the fourth and all further child: 215 EUR per month

    • Below an age of 25 years, if they are doing an apprenticeship

    Kindergeld is something every parent living in Germany should know about. It's money, for you, for free, for every child you have, regardless of your income or marital status.The child benefit is a monthly payment given to all parents in Germany, Poland and the Netherlands, regardless of their income, to ensure that their children’s basic needs are covered. The German child benefit is provided by the Family Benefits Office Familienkasse at the Federal Employment Agency.

    Kindergeld is a monthly children's allowance / benefit (amount detailed below) paid directly to one (tax-paying) parent until the child turns 18. For those with children in higher education or an apprenticeship after the age of 18, the payment will be made until they turn 25, as long as their income does not exceed €7,680 annually. Kindergeld will also be paid until the age of 21 if the child is unemployed and, if the child is unable to work due to a disability, the allowance will be paid for an unlimited time. The allowance also extends to adopted or foster children, as well as your spouse’s children and / or grandchildren if they live in your home. If the child moves out of home after the age of 18 and is still eligible to receive Kindergeld, the money will be paid directly to them.

    Who can claim child benefit?

    Basically, all German children living in Germany, Poland and the Netherlands are eligible for this allowance. And, happily for expats, non-German children living in Germany (even if they’re not born here) are also eligible, as long as they have a valid residency permit. There are even some cases in which children who do not live in Germany are entitled to Kindergeld, for example if one or both of their parents live and work in Germany, Poland and the Netherlands and the country in which the child lives does not have a similar benefit (or does have a similar benefit but at a lower value, in which case the allowance will be worked out based on the difference between the two amounts).

    German and EU citizens are entitled to child benefit, as long as your place of residence is in Germany, Poland and the Netherlands. If you are a foreign national living in Germany, Poland and the Netherlands, you can receive child benefit if you have a valid temporary residence permit or settlement permit. Usually, you must not be receiving any similar benefit in your home country or anywhere else.

    Child benefit can only be claimed by one parent, so married couples will need to decide who receives it. If you and your partner are separated, the parent who has primary custody should claim child benefit. If a child is living with you but you are not their parent, you can still claim child benefit for them.  

    The payment goes to one person who the child lives with. Kindergeld can be claimed by:

    – parents
    – spouses whose stepchildren are living in their household
    – grandparents whose grandchildren are living in their household
    – adoptive parents
    – foster parents
    – guardians or carers or other persons who provide a household for a child

    – parents
    – spouses whose stepchildren are living in their household
    – grandparents whose grandchildren are living in their household

    – guardians or carers or other persons who provide a household for a child

    In the case of a shared household, be it between parents and grandparents, or a biological parent and a spouse, the person who receives the payment is decided by the family. Usually the parents take precedence for the payment. However, this can be waived in the favour of, for instance, a grandparent. The parent must inform the Family Benefit Office, who are in charge of making the payment, of any such agreements in writing. This is done through a declaration of entitlement which can be found at the end of the application form; more on that later.

    If the child does not live at home, or the parents are separated and have shared custody, the parents must decide which of them will receive the benefit. If the parents cannot decide, the case will be decided by a judge in a local court.

    Some families may also be able to claim Kindergeld even while they are out of the country.

    Child benefit age limit

    Usually, you can continue claiming child benefit until your child reaches the age of 18. There are, however, certain exceptions whereby you can continue to receive payments beyond this age limit:

    • If your child is unemployed and registered as a job-seeker with an Employment Agency (up to age 21).
    • If your child is in education or training (up to age 25 or the completion of their first vocational qualification or degree).
    • If your child has a disability and cannot support themselves (up to age 25).

    How much child benefit will I receive?

    The child benefit is paid monthly, usually directly into the parent’s bank account or in cash. The same amount is paid to everyone, regardless of the parents’ income, and is dependent on the number of children you have:

    • 219 euros each for the first two children.
    • 225 euros for the third child.
    • 250 euros for the fourth and each additional child.

    You usually receive child benefit for children up until their 18th birthday. These include:
    • biological and adopted children,
    • stepchildren,
    • foster children,
    • grandchildren.

    If the child is older than 18 years old, you can only receive child benefit under certain conditions. Find more information on this in the .

    Child benefits

    Parents (single parents too) with place of residence in Germany, Poland and the Netherlands receive child benefits. Foreign nationals with a valid settlement permit can also claim child benefits. The amount is depending on the number of children living in your family:

    • 1-2 children: 204 € per month per child
    • For the third child: 210€ per month
    • For 4 and more children: 235€ per month per child

    Benefits are available for:

    • All children up to their 18th year of life
    • For children in job training up to the 25th year of life
    • For unemployed children up to the 21th year of life
    • For children on search for a job training up to the 25th year of life (proof to be handed in)
    • For disabled children, who cannot take care of themselves, no age-restriction (the disability must be existent before the 25th year of life. The claim of disabled children without parents ends with their 25th year of life unless they live in a foster home.)

    Generally, the benefit is paid to the person in whose custody the child is living. If both parents are living together they can decide to whom the benefit is to be paid.

    If a child of age lives away from the parental household, the person who is financing the greater part of the child’s livelihood receives the child benefit. If you, as student, are still entitled to claim child benefit for yourself while you have a baby yourself, child benefit for yourself will only be paid if you forgo your claims to parental allowance and do not take parental leave.

    The application to claim child benefit must be directed in written for to your local family benefits office. Which one is responsible for you depends on your place of residence. More information can be obtained in the family benefits office.

    Children’s allowance

    The children’s allowance is an additional amount on top of the child benefit, which is to help low income families. It can be claimed be single parents and by couples if their children are not married and under 25 years of age. Other criteria are:

    • Child benefit must also be claimed for these children
    • The children must be living in your household
    • The monthly income of the parents is at least equal to the minimum income (900€ for couples, 600€ for single parents) and income and assets do not exceed the maximum income
    • The livelihood of the family is covered with the help of the children’s allowance and other claims on other social benefits schemes will not be made

    The children’s allowance with a maximum amount of 185€/per months per child and is paid out together with the child benefit. If you have more than one child, a total amount of all claims is calculated and then paid out. For certain groups of people, for example students, who’s studies are eligible to be funded with a public grant, the children’s allowance will only be granted under certain circumstances.

    If you are already claiming unemployment benefits II or other social benefits, a claim on children’s allowance is not possible.

    Beneficiaries of the children’s allowance scheme can also claim additional benefits for education and participation. These can be granted to finance school outings, school equipment, tuition or meals at school. The benefits for education and participation can be claimed at the responsible local authorities.
